Abstract

ABSTRACT

The management of wastewater generated by Micro, Small, and Medium Enterprises (MSMEs) continues to face various policy implementation challenges, thereby increasing the risk of environmental pollution. Studies examining the effectiveness of the implementation of Palembang City Regional Regulation Number 26 of 2011 remain limited. Therefore, this study aims to analyze the implementation of the regulation in managing MSME wastewater. This study employs an empirical legal research design with a descriptive qualitative approach, utilizing library research as the primary data source, complemented by field observations. Data were collected from statutory regulations, books, scholarly journals, mass media reports, and observational documentation, and were analyzed using content analysis based on George C. Edward III's policy implementation model, which consists of communication, resources, disposition, and bureaucratic structure. The findings indicate that the implementation of Palembang City Regional Regulation Number 26 of 2011 has not been effective. The main challenges include inadequate dissemination of information and guidance for MSME actors, limited financial capacity and wastewater treatment facilities (WWTPs), low compliance with wastewater management practices, and weak inter-agency coordination and supervision. These constraints have prevented wastewater pollution control from being implemented consistently and sustainably. This study highlights that strengthening policy implementation requires enhanced capacity-building programs, the provision of communal wastewater treatment facilities, improved monitoring and enforcement, and stronger collaboration among stakeholders to improve the effectiveness of MSME wastewater management while promoting sustainable environmental protection.

ABSTRAK

Pengelolaan limbah cair UMKM masih menghadapi berbagai kendala implementasi kebijakan sehingga berpotensi menimbulkan pencemaran lingkungan. Kajian mengenai efektivitas implementasi Peraturan Daerah Kota Palembang Nomor 26 Tahun 2011 masih relatif terbatas, sehingga penelitian ini bertujuan menganalisis pelaksanaan kebijakan tersebut pada pengelolaan limbah cair UMKM. Penelitian ini merupakan penelitian hukum empiris dengan pendekatan kualitatif deskriptif yang menggunakan studi pustaka sebagai sumber data utama dan didukung observasi lapangan sebagai data pelengkap. Data diperoleh dari peraturan perundang-undangan, buku, jurnal ilmiah, berita media massa, serta dokumentasi observasi, kemudian dianalisis menggunakan content analysis berdasarkan model implementasi kebijakan George C. Edward III yang mencakup komunikasi, sumber daya, disposisi, dan struktur birokrasi. Hasil penelitian menunjukkan bahwa implementasi Peraturan Daerah Kota Palembang Nomor 26 Tahun 2011 belum terlaksana secara efektif. Hambatan utama meliputi belum optimalnya sosialisasi kepada pelaku UMKM, keterbatasan kapasitas finansial dan fasilitas Instalasi Pengolahan Air Limbah (IPAL), rendahnya kepatuhan terhadap pengelolaan limbah, serta lemahnya koordinasi dan pengawasan antarinstansi. Kondisi tersebut menyebabkan pengendalian pencemaran limbah cair belum mampu berjalan secara konsisten dan berkelanjutan. Penelitian ini menegaskan bahwa penguatan implementasi kebijakan memerlukan peningkatan pembinaan, penyediaan IPAL komunal, optimalisasi pengawasan, serta kolaborasi antarpemangku kepentingan guna meningkatkan efektivitas pengelolaan limbah cair UMKM dan mendukung perlindungan lingkungan secara berkelanjutan.
